
BENICIA, CA— The city of Benicia filed a lawsuit Monday against a marijuana grow accused of operating illegally. The court action is against the operators and property owners of Evergreen Relief, 2295 Bayshore Road, and comes after the Benicia Police Department discovered the illegal cultivation operation in September while responding to a call for service at the property, city officials said in a news release.
The lawsuit was filed against both the operator of the cannabis cultivation facility and the owner of the property after they failed to shut down operations and cease activities related to the cultivation of cannabis, according to City Attorney Benjamin Stock.
The city is seeking a court injunction that would prohibit the cultivation of cannabis and any other illegal conduct at the premises. The lawsuit further seeks nearly $500,000 in civil and administrative penalties from the defendants.
“While the city of Benicia supports legal cannabis operations and welcomes new cannabis businesses that conform with the law, illegal operations that support the black market for cannabis will be dealt with swiftly and harshly,” said City Manager Lorie Tinfow. “We will use all the means available to us to protect the community from any illegal activity.”
As part of the court process, the defendants will be given an opportunity to respond to the city’s lawsuit.
