PORTLAND, Maine (AP) – Some of Maine’s largest employers no longer test applicants to see if they have used marijuana or if they do, a positive test no longer prevents a qualified candidate from getting a job.

The Portland Press Herald reports It is increasingly common for employers in a state with a tight labor market and legal recreational marijuana to change their drug testing policies.

Rather than using marijuana, many Maine employers are now focusing on making sure employees aren’t high on the job, something experts say isn’t always easy.

“The trend is to take it out of their testing policy because the use of (marijuana) is so widespread and testing doesn’t even come close to determining whether the person is using at work or not,” said Kristin Collins, a lawyer with Preti Flaherty law firm in Portland.

Maine is one of the states with legalized cannabis that does not provide legal protections for recreational users. But the state’s recreational cannabis market has more than doubled monthly sales since the market first opened in October.
